“We’re going to take this truck,” Smich said before the struggle that ended with a gunshot and Bosma’s death. This account was presented by Millard’s lawyer, Nadir Sachak, through statements he put to Smich, who was on the witness stand for his fourth day. He also got a flashlight from the Yukon and searched to see if Bosma’s truck had a GPS tracker. He said there was a brief conversation about calling an ambulance for Bosma, but Smich said, “He’s dead,” Sachak said. Smich got in the driver’s seat of Millard’s Yukon and followed behind Millard, away from the area with Bosma’s body still in the pickup truck, Sachak said.
