A Mexicali Rosa's restaurant in Moncton is under investigation by the provincial government for not paying serving staff properly following a complaint about its labour practices by a former employee. Former waitress Kathlene MacLean said she does not believe Mexicali Rosa's compensated their servers properly for their time at the restaurant. Former waitress, Kathlene MacLean, said she filed a complaint against MexiCali Rosa's for having servers wait, while management chooses when they should punch in based on how busy the restaurant gets. MacLean said she, and other servers, were sent home "multiple times a week" during the three years she was an employee at Mexicali Rosa's. Lamrock said, if these rules were not followed, employees in this situation could eligible for back pay for the minimum hours missed if the Employment Standards Branch finds violations.
