[69] On appeal, the Ninth Circuit vacated the district court ruling, finding that the district court failed to apply the Ninth Circuit’s “purposeful direction” test. [71]On remand, VNG renewed its motion to dismiss arguing lack of personal jurisdiction, and the district court granted the motion. [80] The district court dismissed the first two challenges, but ruled that the as-applied challenge was properly pled.
