Dismissing the man’s appeal against conviction today, Mr Justice George Birmingham said the couple married in 1994 and had a number of children. Mr Justice Birmingham said the jury may have taken the view that what occurred was a continuous event. Mr Justice Birmingham, who sat with Mr Justice Alan Mahon and Mr Justice John Edwards, said the case was properly left to the jury.
