Broadway theater owners should man the barricades after a recent legal decision made them more vulnerable to disability discrimination lawsuits. But, after realizing that hiring two tactile interpreters would cost at least $260, the theater chain denied his request, and McGann sued it for disability discrimination in federal court. The theater chain presents films, and offering individualized interpretations of both the films and the audience reactions during each screening is an entirely different service. But, the appellate court pointed out that the Americans with Disabilities Act specifically defines “auxiliary aids and services” to include qualified interpreters. Like bookstores are not forced to stock their shelves with Braille volumes for their blind customers, the theater chain should not be forced to hire tactile interpreters for its deaf-blind customers.
