The notice cited the Constitution’s Article 50 (1), which says the president can hold office even after the term until his successor takes charge. The Constitution’s Article 123, which stipulates the time for holding elections, says the presidential election has to be held within 90 to 60 days prior to the incumbent president’s term expires. It, however, said that if the president’s term expires within the term of the parliament, which had elected him, the polls will not be held until the next general election is held. According to Akhand, the EC schedule fixing Feb 18 for the presidential election contradicts with the Constitution. “I request the CEC and the Speaker to scrap the schedule within 24 hours or else a petition will be moved to the High Court.”
