A Kakamega court will tomorrow rule on whether Senator Boni Khalwale and his bodyguard Washington Mzozo will face 'retrogressive' charges for participating in a protest. Some 15 advocates, including CORD co-leader Moses Wetangula, had applied for dropping of the charge, which they claimed was last used in 1952 by the colonial government against Mau Mau fighters. Kakamega Senior Principal Magistrate Samuel Wahome failed to deliver a ruling last Friday. The charge "rioting after proclamation contrary to section 83 of the penal code" attracts a life sentence, if convicted.
