Members of the media set up outside the Supreme Court on Thursday as the justices prepare to hear arguments over disqualifying former President Trump from the ballot. It’s been said during Donald Trump’s presidency and afterward that democratic norms and institutions can hold up only if people rise to defend them. On Thursday, the U.S. Supreme Court gave us a glimpse of what it looks like when a democracy is unwilling to defend itself. Ultimately, this is not a question of one state deciding so much as it is the United States Supreme Court looking at the facts and the law — as courts always do — and deciding whether Section 3 disqualifies Trump. Does the Supreme Court live in that world?
