Jury deliberations began Tuesday morning in the case of a nurse charged with manslaughter and criminal negligence causing death for taking a patient off life support, allegedly without the informed, voluntary consent of the patient’s husband. It took two-and-a-half hours to resuscitate her, after which she was placed on life support in the Intensive Care Unit at Georgian Bay General Hospital. Nurse Joanna Flynn, 51, pleaded not guilty to both charges and maintained she obtained consent from Deanna’s husband Michael before taking Deanna off life support around 8:15 p.m. that same evening. The jury will have to decide whether Michael gave Flynn consent to remove life support in keeping with the provisions of the provincial Heath Care Consent Act — including that consent be informed, voluntary and must not be obtained through misrepresentation. So he agreed to take Deanna off life support.
