Xiao was jailed for 17 months after crashing into 23-year-old Tauranga motorcyclist Rhys Middleton on the Napier-Taupo Road in February. But Mike Middleton felt her decision to appeal showed she had not accepted responsibility for her actions. As Tuesday's hearing will be held using an audio-visual link, the Middleton family will not be there to hear the court proceedings. Mike Middleton expected the judge's decision would be reserved for up to a fortnight.
