The Charter’s notwithstanding clause allows governments to override most of these rights. This week, the Ontario government has included the notwithstanding clause to push through an employment contract. If these can be trampled by governments using the notwithstanding clause, our protections are gone. The government cannot be allowed to get away with using the notwithstanding clause to violate human rights — not this time, not ever. It is time to repeal the notwithstanding clause.
