The battle had raged, with each sides brandishing different court orders and celebrating varying victories, until it reached the apex court. On June 7, it announced the registration of five new political parties, bringing the number of parties to 46. On September 10, 2017, a Federal High Court in Abuja equally dismissed the application by Senator Dino Melaye challenging moves by INEC to effect his recall. Justice Dimgba ruled that the recall process is a political question, which is beyond the court to deal with.
