In a recent article in the New Zealand Business Law Quarterly, adjunct professor of commercial law Susan Corbett and I argued a lot of good could come from introducing a spare parts exception into New Zealand copyright law. This will increase competition and should lead to a reduction in prices in the repair and replacement parts market. A further benefit of introducing a spare parts exception is an expected reduction in harmful waste. A spare parts exception would release the stranglehold that manufacturers currently have on the replacement parts and repair market. Whether you agree that a spare parts exception is a good idea or not, the conversation is certainly a timely one, given the New Zealand Copyright Act is currently under review.
