OUR LEGAL REPORTERCalcutta: Calcutta High Court on Tuesday asked the Bengal government to place proper documents to substantiate its claim that payment of dearness allowances to employees was its discretion. In 2016, the SAT had ruled that the DA was a type of donation and the state government staff couldn't claim it as the legal right. The unions sought an order from the court to the state to pay the DA on a par with central government employees. Justice Kargupta asked on what basis the SAT had come to the conclusion that the employees did not have the right to claim DA. So, give us the proper documents to substantiate your claim as well as the SAT's findings that the employees did not have the right to claim the DA," said Justice Kargupta.
