In the petition, Akondsaid the government holds the JSC tests even though the Intermediate and Secondary Education Ordinance, 1961 does not say anything about such examinations. After the upgrading of primary education up to eighth grade from grade five, the primary and mass education ministry had decided to abolish the Primary Education Completion (PEC) exam at grade five. Cabinet Secretary Md Shafiul Alam said on that day, "PEC and JSC tests will continue until the Cabinet makes a final decision on the matter." The government on May 18 announced the decision to upgrade the primary education in line with the National Education Policy, putting also grades six, seven and eight under the primary and mass education ministry’s jurisdiction. Those at the eighth grade in schools and madrasas are appearing in the public exams JSC and Junior Dakhil Certificate (JDC) tests respectively.
