The date for that hearing has yet to be set. Frederick has alleged that the town has treated him unfairly and has made punitive decisions against him. Frederick told the court that he never received notice of the code enforcement officer's decision. The ZBA denied Frederick's appeal of the decision last Aug. 10 because he had missed the 30-day window for filing an appeal. The board on Sept. 26 denied Frederick's request for a reconsideration of its decision on Aug. 10.
