“There must be intention or desire on the part of the accused that the victim should commit suicide and die,” he added. “It is nobody’s case that the accused has abetted commission of suicide by his wife. “Sometimes, the decision to commit suicide might be taken by the victim without any instigation… A person may die like a coward… They are weak minded. Acquits husband from the charge of abetmentTerming the suicide committed by a woman “a foolish act,” the Madras High Court Bench here has set aside the conviction and three years rigorous imprisonment imposed on her husband by a trial court for having abetted the act. For their foolish mentality or decision, another person cannot be blamed,” Justice P. Devadass said.
