The brand new car had been imported in the name of Vasu Pandri Thamala, a fictitious person, by declaring it a used car in order to avail customs duty waiver applicable to NRIs who return to the country. Since the actor paid the differential duty of ₹20 lakh, the officials chose not to prosecute her. Instead, she was included as a prosecution witness in a case booked against Choksey. During the cross examination, Ms. Sen told the defence counsel that it was she who paid the differential duty. He said that the contradiction in the statement made with respect to payment of differential duty would in no way affect the main case related to illegal import.
