Dr. Revwathy Kailairajan, who retired on February 28, had moved the High Court challenging the appointment of Dr. Joe. A single bench granted her relief by setting aside the appointment of Dr. Joe and directed that Dr. Revwathy Kailairajan be appointed to the post. The petition was moved before a vacation bench, which ordered status quo in the case, allowing Dr. Joe to continue as the DME. The High Court directed that a fresh selection process be held considering the cases of Dr. Revwathy Kailairajan, Dr. Joe and Dr. Meenakshi Sundaram in all fairness. Dr. Revwathy Kailairajan moved the High Court claiming that Dr. Joe was continuing as the DME against the order of the court.
