High Court judge Eric Ongola ruled that Kioko will not be evicted until his appeal is heard and determined. Mbwele, who initially did not understand the ruling, asked the court clerk to interpret it for her in the Kamba language. According to court documents in her possession, previous rulings from various courts declared Mbwele the rightful owner of the land. After a while, Mbwele dropped the other children aged between two and six years on the floor of the court and left, catching other court users by surprise. Another ruling delivered in 2010 by the Environment and Land Court in Machakos indicates that the defendant, Mutie Kioko, purchased the land from strangers and not from Muoki Muasya, the registered owner.
