The gauntlet thrown by the Chief Justice, through his advisory to the President to dissolve Parliament over failure to operationalise the two-thirds gender rule has left many dazed. But, could the crisis be the result of a constitutional flaw rather than an institutional fraud? The gender rule in particular has been placed before the Supreme Court for guidance, but with no conclusive direction. Sadly, this weakness of the parsimony principle is not just on the matter of gender rule. Of necessity another one third of the opposite gender would have to be nominated to meet the two thirds gender rule.
