This position was taken by judges Philip Waki, Asike Makhandia and Martha Koome while affirming the decision of the High Court. He is the co-founder of the National Gay and Lesbian Human Rights Commission. His petition was allowed at the High Court in May 2015 but the Non-Governmental Organisations Coordination Board appealed. He therefore moved to the High Court on September 2013 to challenge the refusal.
