Assault with intent to injure has a maximum penalty of three years imprisonment; the theft charge a maximum penalty of three months prison. David Wayne Whitehead, 26, pleaded guilty and was sentenced by the judge to 13 months' imprisonment. The judge agreed to convert it to six and a half months home detention with post- detention conditions and ordered $200 reparation. But Judge Cathcart said the agreed summary of facts showed all four men equally culpable in law either as principles or parties. Incorporating the theft charge, the judge reached an overall global start of 20 months.
