Chief judge Kundan Kumar Kumai rejected the Central Bureau of Investigation’s contention that Gurung was involved in the conspiracy to murder Tamang, a political rival who headed the All India Gorkha League. The court, however, directed that charges be framed against all other 47 accused, including Gurung's wife Asha and several other top leaders of GJM. Counsel for Gurung had said the GJM chief was in Kalimpong at that time, and that the CBI had not provided any proof that he was involved in the conspiracy to kill Tamang.
