Forcillo sentencing hearing continues


James Forcillo to be sentenced to house arrest instead of the mandatory minimum of five years in prison for the attempted murder of Sammy Yatim. The mandatory minimum for attempted murder with a restricted firearm – Forcillo’s police-issued handgun – is five years in prison. The defence is seeking a conditional sentence of two years less a day for Forcillo, or a suspended sentence. The Crown is expected to argue the judge should find Forcillo committed a grave breach of trust by shooting Yatim while he was vulnerable and defenceless. But Forcillo was found guilty of attempted murder for firing an additional six shots at Yatim five-and-a-half seconds later as the 18-year-old lay dying on his back on the floor of the streetcar.
