The 5th US Circuit Court of Appeals issued a temporary stay Thursday night allowing the state of Texas to keep floating barriers in the Rio Grande. A lower court judge had ordered Texas to take down the barriers by September 15 at its own expense. The swift ruling by the 5th Circuit comes a day after US District Judge David Ezra wrote that Republican Gov. Unfortunately for Texas, permission is exactly what federal law requires before installing obstructions in the nation’s navigable waters,” Ezra wrote in his ruling. Texas, meanwhile, maintained it had constitutional authority to deploy the floating barriers.
