PUTRAJAYA: The Federal Court has allowed the application by Datuk Seri Khairuddin Abu Hassan and his lawyer Matthias Chang to strike out two notice of appeals by the prosecution against the decision of the Court of Appeal. Their trial will be heard at the Sessions Court under the Penal Code from May 11. The Court of Appeal had on December 13, 2016 upheld the High Court's decision that both cannot be charged under Sosma for allegedly attempting to sabotage the banking and financial services. On Thursday, Federal Court judge Justice Hasan Lah and the five-man panel he chaired unanimously allowed an application by both to strike out two notices of appeal by the prosecution. Chang's lawyer Zainur Zakaria also argued that the service of notice of appeal to his client is an obligation on the part of the prosecution.
