My colleagues at the think tank Cardus called attention last week to some disturbing news concerning Universities Canada, formerly the Association of Universities and Colleges of Canada. What human rights laws and the constitution permit would not be granted to UC members. One of the prohibited grounds of discrimination is “religious beliefs.” Religious universities could be forced to choose between the identity for which they were founded and continued accreditation. The equality provisions of human rights law bump up frequently against the guarantees of other fundamental freedoms. It specifically requires members to sacrifice the balance sought by “applicable human rights law,” in favour of an unbalanced version of non-discrimination.
