The problem is lurking in three words in the Constitution, “case or controversy.” Federal courts only have jurisdiction to hear a case if there is a case, and that means somebody has standing to sue. Trump’s former students can sue him for selling them a substandard education, former employees can sue him for discrimination, and contractors can sue him for not getting paid. “It’s a stretch.”Trump’s possible violation of the Emoluments Clause runs into similar trouble. Congress rejected Andrew Jackson’s request to keep a gold medal from Simon Bolivar in 1833, but if Trump doesn’t ask permission the only recourse is to impeach him.
