Director of Public Prosecutions has faulted the court under Magistrate Bernard Ochoi for releasing MP Babu Owino. In writing, he has said that "The trial Magistrate Bernard Ochoi made a mistake in law and fact by finding that there was no evidence of the victim having sustained gunshot wounds and that Babu did not intend to shoot the victim". His words can be interpreted to imply that there was an intention to shoot the DJ. If for example, there was no intention, then according to basic logic, the DJ would not have sustained gunshot wounds. What was the need to take him for treatment if at all he was not the one involved in the shooting?
