The prosecution’s key technical witness won’t be allowed to testify as a computer expert in the gas plants trial. Ontario Court Judge Timothy Lipson read aloud the decision Thursday. David Livingston and Laura Miller, once the one-two power in former Ontario Premier Dalton McGuinty’s office, are pleading not guilty to criminal charges involving the alleged destruction of documents in the then-government’s billion-dollar decision to cancel two proposed gas plants in Oakville and Mississauga. It is possible Gagnon could testify about the data he studied without offering any interpretation of it. At that point, the judge said, the message to the team should have been to hire an independent civilian to review Gagnon’s reports.
