The High Court has referred the case seeking to stop new registration of persons by the Ministry of Interior to the Chief Justice to empanel a bench to hear it. Justice Weldon Korir on Friday said the case raises serious constitutional matters of law that should be heard by a bench. The case which has three different petitioners has been consolidated into one case. The petitioners challenging the NIIMS system include Nubians Society, Kenya National Human Rights and Kenya Commission of Human Rights. Some of the counties are; Nairobi, Baringo, Makueni, Embu, Marsabit, Uasin Gishu, Nyandarua, Kajiado, Marsabit, Tana River, Busia, and Kilifi.
