A Nairobi court has suspended a decision by the DPP to prefer murder charges against three police officers who allegedly killed a suspected robber in Gikomba three years ago. The DPP had ordered for the arrest of PC Tom Mbuku, Cpl Ginna Garro and PC Langat Hillary of Kamukunji police station to face murder charges for killing Kelvin Maina in 2020. However, on Tuesday, Justice J. Chigiti suspended the decision pending the hearing of case filed challenging their prosecution. Justice Chigiti suspended the directive from the DPP to arrest the three officers pending the determination of the case saying the orders issued will operate as stay. Through lawyer Danstan Omari, the officers told court that they were chasing the gang when Maina the deceased ambushed Mbuku and demanded his gun that’s why Garro shot him.
