more-inStating that there are discrepancies in the date of occurrence, a Sessions court has remanded an accident case back to a Metropolitan Magistrate (MM) court which had convicted and sentenced the accused to six months’ imprisonment. The accused had challenged the MM order in the Sessions court. Sending the case back to the Magistrate court for a fresh decision, the judge said the Metropolitan Magistrate had wrongly recorded the date of the accident. Independent witnessesThe MM court had also rejected a submission by counsel for the accused that there were no independent witnesses to prove the case. Such kind of weather does not prevail in the month of November or December,” the Sessions court said.
