Angkas riders who attempted to block the government’s supply cap for motorcycle taxis failed to win the side of Mandaluyong City Regional Trial Court (RTC) as the latter dismissed the request for a temporary restraining order (TRO). A four-page order dated January 10, but was only released to the press Wednesday, showed that Mandaluyong City RTC Branch 212 dismissed the petition lodged by Angkas riders against respondents DOTr and LTFRB for lack of merit. Angkas riders also raised this issue, but the court said the petitioner failed to rebut by way of convincing evidence. The presumption, however, prevails until it is overcome by no less than clear and convincing evidence to the contrary. Thus, unless the presumption is rebutted, it becomes conclusive,” the court said in its order.
