They ruled: “We have examined the case and find nothing wrong about the contract as ruled by both the Public Procurement Review Board and the High Court. WELDON KORIRThe company then filed a case at the High Court then on September 2014, Justice Weldon Korir ruled that the EACC’s investigations were unfounded and again allowed the CBK to proceed with the contract. The EACC moved to the second highest court in the land, saying the High Court judge had failed to recognise the “flaws” and “irregularities” pointed out during the procurement process. The Court of Appeal said the procurement review board had not made a mistake when it found the tender process had been duly followed and that nothing could warrant its cancellation.
