A convicted Kamiti lawyer serving a death sentence over robbery with violence has petitioned the court to quash the ruling and start fresh trials against him claiming he was not given impartiality and fairness. He argues that the trial court did not conform to the full requirement of the law pursuant to section 169 of the Criminal Procedure Code. Onyango insists the trial magistrate failed to make certain remarks in the judgment, namely the points for determination, the decision, and the reasons for the decision. It is his contention therefore that the trial court erred, and this, therefore, warrants a retrial. Onyango told the court that he wanted a declaration that the mandatory death sentence is unconstitutional, null and void.
