Photo: PTINew Delhi: Two Congress members of Parliament (MPs) moved the Supreme Court on Monday challenging the rejection of an impeachment notice against Chief Justice Dipak Misra by Rajya Sabha Chairman Venkaiah Naidu. Senior advocate Kapil Sibal sought that the matter be heard by the second most senior judge of the apex court, Chelameswar, as the issue directly concerned the senior-most judge, Misra. On 23 April, Naidu rejected the impeachment motion moved by Congress-led opposition parties on 20 April, holding that it lacked substantial merit. Section 124(4) of the Constitution outlines the process of impeachment of the CJI on the ground of “proven misbehaviour or incapacity”.
