'Compulsive litigant' banned from taking further legal action after 25-year battle with council


A man's 25-year battle to subdivide his land has resulted in a High Court ruling which bans him from taking any more legal action for the next five years. A ruling last month by the High Court described Mawhinney as an almost "compulsive litigant" who resorted to litigation "at the drop of a hat", exposing Auckland Council to "significant expense and inconvenience". Court documents revealed that he had been made bankrupt twice after a number of his proceedings since 1996 were struck out. Mawhinney's legal battle for the Waitakere land began in 1996 when he attempted to obtain subdivision consents under the Resource Management Act. The court said the way Mawhinney conducted his proceedings had many hallmarks of what would be considered a "vexatious claim".
