Cleary Gottlieb, in collaboration with the American Civil Liberties Union of Louisiana, submitted a petition for a writ of certiorari in the U.S. Supreme Court in Williams, et al. v. Davis, on behalf of Remingtyn Williams, Lauren Chustz, and Bilal Ali-Bey—putative class action plaintiffs whose protest after George Floyd’s murder was dispersed by law enforcement officers with excessive force. In reaching the standing question, the Fifth Circuit purported to exercise pendent appellate jurisdiction, finding that it could do so because the standing issue merely “significantly overlap[ped]” with issues of state sovereign immunity. The petition was submitted to the Supreme Court on April 6, 2023, and docketed on April 10, 2023. Read the petition here.
