It’s no secret that the big carriers have been shrinking seat space. So the group asked the FAA to impose a moratorium, preventing airlines from shrinking seats any more than they already had while the agency prepared its first-ever regulations on the issue. As for evacuations, the FAA said it had looked into the matter, ran its own tests, and all was well. The FAA had “reasonably concluded that matters pertaining exclusively to passenger ‘comfort’ are not within its regulatory wheelhouse,” Judge Millett wrote. So the FAA was ordered by Millett and two other judges on the court to go back and take another look.
