But six days later, the CJC received another complaint, this one from the Indigenous Bar Association. It was essentially the same complaint: The judge shouldn’t have stuck his toe in these waters, and should have known how his involvement might be seen. The matter became an issue in the local elections, with the no-to-the-settlement slate winning the day. He “deferred” the decision to another member of the judicial conduct committee, Associate Chief Justice Robert Pidgeon, who decided to send the matter to a public hearing. Newbould’s lawyer, Brian Gover, is asking the Federal Court to quash that decision, arguing that the CJC has no jurisdiction to reconsider a matter it already decided.
