Share TweetBy Jun RamirezThe Court of Tax Appeals (CTA) has nullified the more than P57 million tax deficiencies slapped by the Bureau of Internal Revenue (BIR) against a Manila business executive and mother of Senator Manny Pacquiao due to incorrect audit procedure. The full court said the LN should had been converted into a Letter of Authority (LA) as required under the Tax Code to make the assessment valid. The taxpayer insisted that it did not receive both the preliminary and final assessment notices allegedly sent by the BIR. “Considering that the void assessment bears no valid fruit, the subject assessment cannot attain finality, thus the corporate taxpayer (Dimson) cannot be held civilly liable to pay the tax deficiencies,” the court added citing Rule 133 of the Revised Rules of Court.
