Suspended Supreme Court judge Philip Tunoi has accused the Chief Justice of using his position to interfere with judges’ retirement age case. However, the society said the CJ does not have powers to vary the orders granted by a fellow Supreme Court judge. Through his lawyer Pheroze Nowrojee, the suspended judge said the decision by CJ Willy Mutunga to call for the file in the retirement age case and giving early hearing dates amount to interference. Yesterday, Nowrojee said the CJ in exercising his administrative powers and expediting the hearing of the controversial case contravened the constitution. In the case, Deputy Chief Justice Kalpana Rawal and Tunoi are challenging a decision to have judges retire at 70.
