This comes after state power regulator WBERC on February 16 rejected "the scheme for arrangement in regard to the reorganisation or petitioner's activities including its electricity distribution and generation activities". The generation business would house the thermal power generating stations in West Bengal currently held directly under CESC Ltd and also of Dhariwal Infrastructure based in Maharashtra and Noida Power. The distribution business would have the old licence for Kolkata and adjoining areas plus the several recent distribution licences acquired in several areas of Rajasthan. CESC, however, told NCLT that WBERC has to approve and is entitled to regulate power purchase agreement to be entered into CESC Ltd and Haldia Energy Ltd consequent to the transfer of generation undertaking to Haldia Energy. "Senior Counsel appearing for the petitioners submits accordingly that the said order of WBERC doesn't stand in the way of sanction of the scheme by this tribunal," the order said.
