NEW DELHI: The Supreme Court said on Tuesday there was no illegality in the appointment of Gujarat-cadre IPS officer R K Asthana as CBI special director, and upheld the Centre's decision to elevate him.A bench of Justices R K Agrawal and A M Sapre dismissed a PIL that challenged Asthana's appointment. The agency has registered an FIR in the case.The court said there was unanimity among members of the selection committee to appoint Asthana to the post, and allegations that the CBI director had opposed his appointment were wrong. "We cannot question the decision taken by the selection committee which is unanimous and before taking the decision, the director, CBI, had participated in the discussions and it is based on relevant material and considerations. Further, even in the FIR filed by the CBI, the name of Rakesh Asthana has not been mentioned at all. Significantly, the court alsotrashed reports that the selection committee had last month failed to arrive at a decision regarding Asthana's elevation.The court passed the order after going through the minutes of the meeting that said the selection committee had unanimously taken a decision and there was no divergence of opinion among members on Asthana's appointment.
