Today, Meritor is viewed as a landmark case that officially recognized sexual harassment as an impermissible form of discrimination. Sexual harassment lawsuits are one area where this systematic bias appears; racial discrimination lawsuits are another. There are easy ways to start fixing this problem when it comes to sexual harassment. And judges must reject interpretations of “severe or pervasive” derived from cases that were wrongly decided. But we have to make sure the laws we have in place actually protect workers the way they were intended to.
