Bombay HC: Tender issued to create monopoly for handful of suppliers


The Aurangabad Bench of the Bombay High Court, setting aside the tender notice, has indicated that it was issued in a manner that would create a monopoly for a handful of suppliers. It would not be in consonance with the decentralisation policy as envisaged by various departments and the Supreme Court. It shall thereafter proceed to form projects (blocks), and issue a tender notice accordingly,” the court has ruled. An essential condition of the tender states that a supplier must hold an annual turnover of over 25 per cent of supply quantity. The government is exploring the legal recourse of either complying with it or challenging it in a higher court.
