O’Neill ruled that prosecutors were not bound by the former district attorney’s decision, and he allowed the case to go forward. That delay, the lawyers said, had allowed evidence to disappear, and they said other women had come forward with unverifiable claims that had damaged Mr. Cosby’s reputation. “The motion filed today is primarily a rebranding of the same failed arguments the Cosby defense team has previously put forth,” Mr. Steele said in a statement. Dolores M. Troiani, a lawyer for Ms. Constand, did not immediately respond to a request for comment.
