KUALA LUMPUR: A total of 100 Bertam Valley residents in Cameron Highlands have won their negligence suit against Tenaga Nasional Berhad (TNB) over the flood situation five years ago. In allowing the residents' suit, Justice Nordin said the release of water from the dam was not a correct decision in the absence of an in-flow measurement instrument. "Failing to have one, I find that it was a negligence act on the part of the defendant (TNB). The omission has put the lives and property of Bertam Valley residents in aggrieved and the risk turned into reality in 2013. They alleged that TNB failed to warn the people and the plaintiffs to move to a safer place with their belongings.
